Article 1: General Provisions

The electronic shop of Onivu/Habets, with registered office at 3650 Dilsen-Stokkem (Belgium), Rijksweg 406, VAT BE 0699,079,394, HRT 52639 (hereinafter ‘Gintique) offers its customers the opportunity to purchase their goods online.

These General Terms and Conditions (“Terms”) apply to all items from the online webshop and every online purchase that the customer places at Gintique.

The customer accepts that these Conditions shall be solely applicable to the exclusion of specific conditions of purchase for certain products or services, even if they would stipulate that they are the only applicable. Any clause contrary to these Conditions shall be binding only if Gintique will have expressly accepted in writing.

NOTE : We do not sell to minors

Under the Act of January 24, 1977 on the protection of the health of the users in terms of food and other products, sales and distribution of alcohol is forbidden to young people under eighteen. Article 2: Price

Article 4: Online Purchases

Article 5: Retention

The delivered goods remain until the moment of complete payment by the customer, the exclusive property of Gintique.

The risk for loss or damage, however, is transferred to the customer from the delivery or collection. The customer agrees, if necessary, to appoint a third party on the retention of Gintique example to anyone who would seize the not yet fully paid items.

Article 6: Complaints

It can always occur that the outer packaging, and in doing so incurs the content of your delivery, damage during the transport. Article 7: Guarantee

1. Legal warranty

Under the Act of September 21, 2004 on the protection of consumers in consumer sales, the consumer has legal rights. Each article is subject to the statutory warranty from date of purchase (or delivery to) the first owner. Any commercial warranty leaves these rights without prejudice.

2. General

To invoke the warranty, the customer must present proof of purchase.

To determine the warranty period, we will look at the billing date and the date of first registered, motivated and written notification. Send an email to our customer service (Article 12: Customers of Gintique) is accepted in this context as writing and being registered.

(Commercial and / or legal) warranty does not apply to defects arising from accident, neglect, falls, abnormal or incorrect use, use of the product contrary to the purpose for which it was designed, non-compliance with the instructions or manual adjustments or modifications to the article, rough use, poor maintenance, abnormal or incorrect use. The warranty is not transferable.


Under the guarantee Gintique can be held up to the free repair, replacement or refund of the goods supplied to the exclusion of all other indirect and / or consequential damages (see Article 20: Damages).

Article 8 – Exclusion of right of withdrawal

You have the right to cancel your order within 14 days after receipt without giving any reason. You have canceled again after 14 days to send your product back. You will then be credited with the total amount, including shipping. Only the costs for returning home to shop for their own account. If you return your product, you will need to send it back in the state you received it (original package). To exercise this right, please contact us via info@Gintique.com. We will then order amount owed within 14 days after registration of your return item.

9: Depletion of validity – Non-renunciation

If any provision of these Terms be invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions.

Failure at any time by Gintique to enforce any of the rights set out in these Terms, or equal to exercise any right of this, will never be seen as a waiver of such provision and will never affect the validity of these rights.

Article 11: Changes to the Terms

These Conditions are supplemented by other conditions where an explicit reference to, and the general conditions of Gintique. Gintique may change without notice these Terms. Any purchase after the change, keep an acceptance by the customer of the new Terms.

Article 12: Evidence

The customer accepts that electronic communications and backups can be used as evidence.

Article 14: Applicable law – Jurisdiction

The Belgian law is applicable, except for the provisions of international law concerning applicable law and the Rome I Regulation on the International Sale of Goods. In case of disputes, we will proceed to the court in Tongeren (Belgium).
